About this lecture

Banking Law Case 24 of 29 by Law Easy, for LL.B., CLAT PG, UGC NET Law and Judiciary exams. Case: Dayawati v Yogesh Kumar Gosain (2017), Delhi High Court (Division Bench, Acting Chief Justice Gita Mittal), decided 17 October 2017, answering a reference made by a magistrate. FACTS: Two cheques of Rs 11 lakh and Rs 16 lakh, given for firefighting equipment, had bounced. The parties settled through court-annexed mediation, but the accused paid only part of the first instalment. LEGAL ISSUE: Can a Section 138 complaint be referred to mediation, how should the settlement be recorded, and what follows if a party defaults? JUDGMENT: The High Court held that a complaint under Section 138, being compoundable, can lawfully be referred to mediation. The magistrate records the parties' statements and undertakings and accepts the settlement if it is voluntary and lawful. If the accused later defaults, the amount can be recovered as if it were a fine under the criminal procedure code, now the B.N.S.S., and he may also face action for breaking his undertaking to the court. But such a settlement is not a civil decree and cannot be executed in a civil court. PRINCIPLE TO REMEMBER: Under Section 147 every offence under the Act is compoundable. Compounding means the complainant and the accused settle and the case ends in acquittal. A mediator helps the parties agree but does not decide the dispute like a judge. To encourage early settlement, the Supreme Court has laid down graded costs; under its guidelines an accused who pays the cheque amount before his defence evidence is recorded can compound without any cost. PROVISIONS: Sections 138 and 147 of the Negotiable Instruments Act, 1881; recovery as a fine under the criminal procedure code (now B.N.S.S., 2023). EXAM NOTE: A mediated agreement in a criminal cheque case does not automatically become a civil court decree. The court must use the legally proper enforcement route. One party's mere proposal does not compel the other to give up the complaint.
