About this lecture

Banking Law Case 07 of 29 by Law Easy, for LL.B., CLAT PG, UGC NET Law and Judiciary exams. Case: In re Chotanagpur Banking Association Limited (1967), Patna High Court (Justice N. L. Untwalia). FACTS: Chotanagpur Banking Association Limited was a bank being wound up. Two proprietors of a firm that owed money to the bank filed insolvency petitions before the district judge. LEGAL ISSUE: Could the district judge hear insolvency cases that affected the recovery of the bank's dues, or did only the High Court dealing with the winding up have jurisdiction? JUDGMENT: The Patna High Court held that the district judge had no jurisdiction. Declaring a debtor of the bank insolvent would affect recovery of its dues, which is a question arising in the winding up, and only the High Court could decide it. PRINCIPLE TO REMEMBER: Section 45B of the Banking Regulation Act, 1949 (Part IIIA, special provisions for speedy disposal of winding-up proceedings) gives the High Court exclusive jurisdiction over any claim by or against a banking company being wound up and any question of law or fact arising in the winding up. One forum for a failed bank's disputes helps depositors get paid quickly. PROVISIONS: Banking Regulation Act, 1949, Part IIIA and Section 45B. EXAM NOTE: This concerns proceedings affecting the winding up of a banking company. It is not a rule that every dispute involving any bank must go to a High Court.
