Must an accused person prove innocence? BSA Section 104 of the Bharatiya Sakshya Adhiniyam, 2023 places the burden of proving asserted facts on the person asking the court to decide on them. In the Act’s criminal illustration, the person seeking punishment must prove that the accused committed the crime. Other provisions can place a burden on a party for specific facts or exceptions. #BSA #BurdenOfProof #Section104 #EvidenceLaw #IndianLaw
