Case 20 of 30 in Law Easy's Media Law series. Anuradha Bhasin v. Union of India, Supreme Court of India, decided 2020.
FACTS
After the changes concerning Jammu and Kashmir in 2019, internet services were suspended and restrictions were imposed. Anuradha Bhasin, a newspaper editor, and others challenged the shutdown.
WHAT THE COURT HELD
In 2020 the Supreme Court applied the test of proportionality: a legitimate aim, a suitable means, no less restrictive but equally effective alternative, and a balance between harm to the right and the benefit gained. It held that an indefinite suspension of the internet is not permissible, and that such orders must be published and periodically reviewed. Speech and trade through the internet receive constitutional protection.
EXAM POINT
Distinguish the protected use of the internet from a stand-alone constitutional right to internet access.
