About this lecture

Understand theft under Section 303 of the Bharatiya Nyaya Sanhita, 2023 (BNS). This Law Easy lecture breaks down the five elements of theft: movable property, possession, lack of consent, movement and dishonest intention, using practical examples and two case laws. The video explains how an owner may steal property from another person's lawful possession, why an honest claim of right can defeat dishonest intention, and how theft differs from dishonest misappropriation under Section 314. Ram Ekbal Rai v Jaldhari Pandey (1972) examines a disputed crop and possession; Vithal Yedu Khalse v State of Maharashtra (1982) examines the absence of dishonest intent. The lecture also covers punishment under Section 303(2) and related BNS Sections 304–307 on snatching and specific forms of theft. Designed for LL.B. Criminal Law, Judicial Services, UGC NET Law, CLAT PG and semester exam revision.
