About this lecture

Compare three approaches to divorce in Indian Family Law: fault, mutual consent and irretrievable breakdown of marriage. This Law Easy lecture uses the Hindu Marriage Act, 1955 and Supreme Court decisions to show how each approach works. Learn the fault grounds of cruelty, adultery and desertion under Section 13, the requirements of mutual consent divorce under Section 13B, and why irretrievable breakdown is not itself a statutory ground under the Hindu Marriage Act. The lecture explains Naveen Kohli v Neelu Kohli (2006) and the Supreme Court's power under Article 142 discussed in Shilpa Sailesh v Varun Sreenivasan (2023). It also briefly compares mutual consent routes under other personal laws. Helpful for LL.B. Family Law, law university exams, UGC NET Law, CLAT PG and Judicial Services revision.
